Gina Carano’s ‘Mandalorian’ Firing Lawsuit Is Actually Moving Forward

Gina Carano’s ‘Mandalorian’ Firing Lawsuit Is Actually Moving Forward

Gina Carano’s lawsuit against Disney for her firing from The Mandalorian has many…odd aspects to it. The filing with an elaborate Star Wars metaphor, one of the conditions is that she be rehired to the show, and the entire thing is bankrolled by Elon Musk as her firing was due in part to controversial comments she made on Twitter ranging from transphobia to comparing persecuted Republicans to Jews in World War II.

But as wild as it may seem on its face, we now have word that it is actually moving forward after a judge declined to dismiss the suit. So that means either it goes to trial or Disney and Carano have to settle. Here’s what the judge says:

“As an initial matter, unlike the Boy Scouts or the Jaycees, Defendants are not members-only, nonprofit organizations. Instead, Defendants are for-profit corporations who, as relevant to this lawsuit, employ actors such as Plaintiff, as well as administrative staff, to create television series and films,” he wrote.

He added that Disney had not produced any evidence that actors must have certain “moral” characteristics to be employed like they claim, saying that they need to have “respect, decency, integrity or inclusion.” The judge isn’t declaring Carano has those things, only that Disney doesn’t have evidence that it retains actors based on those traits.

Disney has said it was the Nazi remark that crossed the line, previously stating:

“Carano’s decision to publicly trivialize the Holocaust by comparing criticism of political conservatives to the annihilation of millions of Jewish people — notably, not ‘thousands’ — was the final straw for Disney.”

Back in April it was then tossed to the judge to be thrown out or not, and now, it hasn’t.

It’s unclear if Disney will actually take this to court or not, as maybe they just quietly settle with Carano. Her claim is that she wants to be rehired via a court order and receive damages of at least $75,000. Disney seems likely that they might do the later, but the former is pretty absurd. There was a joke at the time that they could rehire her then immediately kill her character off.

It is hard to argue that Carano’s career has not been harmed by all this as she has now been relegated to starring in conservative-funded movies like Terror on the Prairie and My Son Hunter, the later of which is a drama loosely based on Hunter Biden. But whether that harm is purely Carano’s fault or Disney overreaching is what the case is now about, and it’s a surprise to most it has gotten this far.
